Terms of service

1. Who we are. This website is operated by Hearth & North, a sole proprietorship, based in Muskoka, Ontario, Canada. By using this site or placing an order, you agree to these terms.

2. Products. Our garments and goods may be manufactured outside Canada. Colours shown on screen may differ slightly from the finished item because of screen settings and the nature of garment dyeing, embroidery and print processes. Small variations are normal and are not defects.

3. Sizing and fit. Sizes follow the size guide on the site; between sizes, size up. Sized items can be returned under the Refund Policy.

4. Orders and payment. When you place an order, you are making an offer to buy. We accept it when we send a confirmation email. We may decline or cancel an order at our discretion, for example if an item is unavailable, a price was listed in error, or we suspect fraud. If we cancel, you receive a full refund. All prices are in Canadian dollars. Applicable taxes are added at checkout.

5. Shipping and delivery. See our Shipping Policy. Delivery estimates are estimates. Risk in the goods passes to you on delivery to the address you provided.

6. Returns and refunds. See our Refund Policy. Nothing in these terms limits any rights you have under the Ontario Consumer Protection Act or other applicable law.

7. Discount codes and promotions. Codes are for personal use, one per order, and cannot be combined unless stated. We may end a promotion at any time.

8. Intellectual property. The Hearth & North name, mark, wordmark, lockup designs, artwork (including the pine and lake horizon), photographs and site copy belong to us. You may not copy, reproduce or use them commercially without our written permission. Purchasing a product does not transfer any rights in the design.

9. Custom, trade and wholesale orders. Custom, corporate, trade and wholesale orders are governed by a separate written quote and are not subject to the change-of-mind return in our Refund Policy.

10. Your account and conduct. You agree to give accurate information, to keep your account details secure, and not to use the site for anything unlawful or that interferes with its operation.

11. Limitation of liability. To the extent permitted by law, our liability for any claim relating to a product or this site is limited to the amount you paid for the product in question. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot be excluded under Canadian law.

12. Third-party links and services. The site may link to other websites or rely on third-party services (for example, payment or shipping providers). We are not responsible for their content or practices.

13. Governing law. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be dealt with in the courts of Ontario, unless applicable consumer law gives you the right to bring a claim elsewhere.

14. Changes. We may update these terms from time to time. The version on the site when you place your order is the one that applies to that order.
